Soviel Anfang war noch nie! - Oder doch? - Oder ist endgültig Schluß mit den Anfängen? Niemand jedenfalls scheint mit Anfängen noch viel anfangen zu können, und am Ende vielleicht sollte man von Anfang an die ›Stunde Null‹ grundsätzlich nur als Endpunkt einer Katastrophenzeit verstehen. So würde unter allen Neubeginn sogleich ein Schlußstrich gezogen. - Zunächst aber beginnt die Sache ganz harmlos: Herr Paul verkörpert Kontinuität, Standhaftigkeit und Konsequenz. Herr Paul lebt seit Jahrzehnten in einer zerfallenden Fabrik, geht niemals auf die Straße und verweigert jede Arbeit. Herr Paul kennt das Leben, ohne die Welt je gesehen zu haben. Herr Paul leistet nichts, Herr Paul leidet nicht, Herr Paul scheint recht zufrieden.Herr Helm dagegen lechzt nach Veränderung. Leistung ist sein Credo, Dynamik seine Passion. Helm hat geerbt und strebt nun danach, sein Glück zu machen: Die alte Seifenfabrik soll zur Großwäscherei umgebaut werden. Voll Aufbruchstimmung will Helm ins satte Menschenleben greifen, wo sich so viel tut, da muß auch er noch tätig sein. Aber: Herr Helm hat kein Geld, statt dessen hat er ein Problem: Herrn Paul.

Drei Haftungsregime für künstliche Intelligenz

Wer trägt das Risiko, wenn künstlicher Intelligenz – etwa ChatGPT – schadensträchtige Fehler unterlaufen? Wenn die beteiligten Menschen sorgfältig gehandelt haben, haftet nach geltendem Recht – niemand. Um dieser gravierenden Verantwortungslücke zu begegnen, entwerfen Anna Beckers und Gunther Teubner drei rechtliche Haftungsregime, für die sie Erkenntnisse aus der Soziologie sowie der Moral- und der Technikphilosophie heranziehen: Prinzipal-Agenten-Haftung für Handlungen autonomer Software-Agenten (»Aktanten«), Netzwerkhaftung für verdichtete Mensch-KI-Interaktionen (»Hybride«) und fondbasierte Entschädigung für vernetzte KI-Systeme (»Schwärme«). Ein bahnbrechender Lösungsvorschlag für eine hochaktuelle Problematik.

The case for societal constitutionalism

This volume collects and revises the key essays of Gunther Teubner, one of the world's leading sociologists of law. Written over the past twenty years, these essays examine the 'dark side' of functional differentiation and the prospects of societal constitutionalism as a possible remedy. Teubner's claim is that critical accounts of law and society require reformulation in the light of the sophisticated diagnoses of late modernity in the writings of Niklas Luhmann, Jacques Derrida and select examples of modernist literature. Autopoiesis, deconstruction and other post-foundational epistemological and political realities compel us to confront the fact that fundamental democratic concepts such as law and justice can no longer be based on theories of stringent argumentation or analytical philosophy. We must now approach law in terms of contingency and self-subversion rather than in terms of logical consistency and rational coherence.
